Thank you for using the unique mobile WIFI device (the “Device”) provided by WizerFi (WizerFi, we, us) at this website and at our mobile app (together the “Website,” or the “Site”). Our mission at WizerFi is to make mobile internet easy and affordable worldwide for anyone on the go and we will gladly work with each customer at each step in their journey. We have created these terms and Conditions of Use (the “Terms”) in order To assist you in using the Website, mobile app and device.

Agreement

These entire terms govern your use of the Website, mobile app and device and apply to any visitor at our Website, including casual visitors to our Site (“Site Visitors”), and individuals who conduct transactions at our Site (“Site Customers”).

Grant of Rights

Provided you comply with these Terms, we grant Site Visitors, and Site Customers the right to access all publicly available areas of the Website for purposes of learning more about our services and, with respect to Site Customers, the right to access all password protected areas of our Site and to participate in all of our offerings for which they are eligible (collectively “Permitted Purposes”). Apart from your express right to use the site and the device for Permitted Purposes, you may not use, copy, modify, distribute, or access our Website, or any materials we have made available on the Site.

Reservation of Rights All information, software, artwork, text, video, audio, pictures, logos, and other content on the Website or embodied in our online services, devices and applications are protected by copyright and other intellectual property laws, and are owned by WizerFi and its licensors, or are included under principles or “fair use”. WizerFi retains all rights with respect to the Website except those expressly granted to you in Section 2, above.

It is absolutely forbidden for the User to change, advertise, broadcast, participate in the transfer or sale, create derivative products or make use of any kind of the content as mentioned, in whole or in part.

The intellectual property rights belong to WizerFi, as mentioned, even when there is not a specific indication stating this on the Device or in one of the contents, and this has been specifically clarified to the User.

Any deviation from this policy may lead to a breach of copyright, infringement of trademark or other intellectual property which leaves the person in breach open to civil claims and/or criminal proceedings.

Registration

In order to purchase the services in our site, users must complete a full registration process, and fill in their entire personal details, including credit card details or activation code and afterwards confirm the agreement to these Regulations. On completion of the above activity, Users will receive an SMS and email message confirming that registration has been completed.

Registration to site constitutes the User’s agreement to receive SMS and e-mail from us, which may include updates on a range of subjects, details of the enactment of a transaction, advertising and so forth.

Device usage

WizeFi users are granted with the right to use the services and devices, according to WizerFi’s purchase plans. WizerFi is the sole owner of the devices and the rights to the designated applications installed on the device. Usage of the Device is considered as reasonable usage, excluding software update and/or heavy files download/upload, and should be made according to WizerFi's instructions and regulations. You undertake to read the details of these regulations , and hereby confirm that you irrevocably and unconditionally, accept all its contents. For all intents and purposes, these regulations constitute a usage agreement for the Device between WizerFi and the User.

According to these regulations, you agree that you will strictly NOT do any of the following:

make repairs or modifications, or alter in any way, the Equipment (including but not limited to the swapping of a non-authorized Equipment battery).
remove or alter any certification markers affixed to the Equipment.
share the Equipment with any third party, or allow any such third party to use the Equipment, with the sole exception of a family member, companion, or friend on your trip.
grant any interest in the Equipment to any third party; or
use the Equipment for any illegal purpose, including in violation of your jurisdiction (including but not limited to copyright laws).
use the Products and Services or its content for any unlawful purpose.
remove the SIM card installed in the Device, transfer it to another device, make any use of it other than with the Device or install any other SIM card in the Device.

WizerFi reserves the right to terminate your use of the Product and Services for violating any of these prohibited uses in Section 5.

Usage period

Single usage day shall be considered as any usage period between one (1) second and twenty four (24) hours, and shall be counted from the moment you turn on your WizerFi device. Any usage day made according to these usage terms shall be charged as a single full usage day.

Owner warranty

While WizerFi was designed to be an enduring travel companion, we understand sometimes products are in need of servicing. We are happy to exchange or repair any defective units or parts within one-year of when you received your order. Please contact our client support so we can assess any product issues and help resolve.

Cost of Services

Cost of services is as stated on the website or any other amount that has been agreed with you in writing at the time of placing your order. WizerFi may change the cost of services from time to time, without prior publication of same.

Cancellation Policy

In the chance that you’d like to return your order, you must do so within 30 days of your delivery date and your item must be unused and in the same condition that you received it. It must also be in the original packaging. You will be responsible for return shipping costs and must include track-able shipping service. Once we receive your returned item, you’ll receive confirmation from our team and your refund will be processed through your original method of payment within 14 business days.

Full unused usage days may be added to an existing user’s account and saved for a period of 3 months.

All requests under this section must be made exclusively by the holder of the credit card, and sent by e-mail to support@wizerfi.com. In order to receive a refund, or save usage days, confirmation must be received from us by return e-mail.

Submitted website Content

If we decide to allow postings to our Website, and if you post content to our Website, by electronic mail or otherwise, we will treat the content as non-confidential and nonproprietary to you. By posting content on the Website, you authorize us to use and allow others to use, distribute, modify, and copy the content, without compensation to you and for so long as we deem warranted (collectively, “Use Rights”). Moreover, in posting this content to our Website, you warrant that you have sufficient authority and right to post the information, and provide these Use Rights.

Website Code of Conduct

As a condition to your use of the Website, you agree to follow our Code of Conduct, set out below. Under this Code, you will not:

Use the Website in a manner that could disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site.

Seek to obtain access to any materials or information through “hacking” or through other means we have not intentionally made available to you through the Website.

Submit material that is intentionally false, defamatory, unlawfully threatening, or unlawfully harassing.

Transmit materials through the Site that you know or should know contain viruses, Trojan Horses, worms, time bombs, cancelbots, or other computer- programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.

Infringe any third party’s copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy without the copyright owner’s permission, or without a legitimate “fair use” justification for the transmittal.

Disseminate materials that invade the privacy of others, such as photographs, video clips, sound recordings, personally identifiable information, or other materials that reveal personal, private or sensitive information about another person, without that person’s consent.

Transmit or display obscene materials and the Website for any purpose that is unlawful or prohibited by these Terms.

We will enforce the above Code of Conduct wherever we deem necessary. However, WizerFi does not control – and does not necessarily endorse – the content, messages, or information found in any community area we may make available via the Site. When you participate in such areas, you do so at your own risk, and we expressly disclaim responsibility for the content, messages, or information found in these areas.

Links to Third-Party Sites

The Website and mobile app may contain links or produce search results that reference links to third party Websites and/or mobile apps (collectively “Linked Sites”). WizerFi has no control over these Linked Sites or their content and does not assume responsibility or liability for any content, opinions, or materials available on Linked Sites. WizerFi does not endorse the content of any Linked Site, nor does WizerFi warrant that a Linked Site will be free of computer viruses or other harmful code that can impact your computer or other Web-access device. By using the Website to search for or link to another site, you agree and understand that such use is at your own risk.

Confidentiality and Privacy

WizerFi will not transfer any details of a Device User to any third party, without the said User’s prior written consent, other than for the purpose of providing services to the User, improving the service provided to WizerFi’s customers, or based on the requirements of law. We wish to clarify that any identifying detail that a User enters in third party applications, including browsers and websites, within the framework of his use of the Device, is not under of WizerFi’s control and WizerFi takes no responsibility in the event that same reaches the possession of any third parties.

Without derogating from the above, we wish to clarify that anyone who provides his details over the Internet, does so exclusively at his own responsibility.

The site operators and WizerFi have the right to utilize the User’s personal information for internal purposes such as aggregated data analysis relating to purchaser stereotypes and user and/or supplier behavior and for the investigation of complaints and/or criticism including the use of cookies.

Revocation or Suspension of Use Privileges

We reserve the right at any time to terminate or suspend your access to any of our services, without any prior notice, if you engage in activities that we conclude, in our discretion, breach our Code of Conduct, fail to complete payment or breach any of these terms of use. For the avoidance of any doubt, suspension of use will not replace any compensation and/or reward and/or any legal right which is granted to WizerFi as a result of this breach.

Warranty Disclaimer

WizerFi does not guarantee that the Website and mobile app will be error-free or uninterrupted, or that the Site will provide specific results from your use of any content, search, or link on the Site. The Site, mobile app and all their service are delivered on an “AS IS” and “AS AVAILABLE” basis. WizerFi does not warrant or represent that files you download from the Site and mobile app will be free of viruses or other harmful features. WizerFi disclaims all warranties, express or implied, including any implied warranties of merchantability, non-infringement, and fitness for a particular purpose. You expressly agree that use of the WizerFi site and related services is at your own risk.

Limitation of Liability

Under no circumstances, including but not limited to, breach of contract, tort or negligence, will WizerFi be liable for any direct, indirect, special, incidental, punitive, exemplary, or consequential damages (including lost profits) that arise out of or are related to your use of the WizerFi site and device. In no event shall WizerFi aggregate liability to you for any loss, damage or claim related to or arising out of the site or any services you receive from the site and/or mobile app (“SITE SERVICES”).

WizerFi will not be party to any business arrangement made between the User of the Device and different sites to which he surfs or within the framework of surfing sites or using applications, and it will take no responsibility whatsoever deriving from the exposure to improper user content including content not for users under the age of 18. The content of this clause also applies in the event that the surfing is done using applications developed or supported by the WizerFi.

Indemnity

You agree to defend, indemnify, and hold WizerFi and its subsidiaries, affiliates, officers, directors, agents, and employees harmless from any liability to third parties, including reasonable attorneys’ fees, arising from or related to your breach of these Terms.

Assignment

These Terms of Service shall not be assignable by you, either in whole or in part. WizerFi reserves the right to assign its rights and obligations under these Terms.

Modifications of these Terms

WizerFi reserves the right to modify these regulations from time to time, and all use of the Device constitutes agreement to the conditions of the regulations that may be current at the time and which can be read using the Device prior to use.

WizerFi will only be obligated by what appears here in the regulations. In any event of contradiction between any other publication and the regulations, the regulations shall prevail.

If we modify these Terms, any such modifications will take effect proactively, upon your subsequent access to the Website and/or mobile app.

General

These entire terms shall be governed in all respects by the laws of Israel without giving effect to its conflicts of law provisions. Both parties submit to the personal jurisdiction of and venue in the courts of Tel Aviv, Israel. The parties further agree that any cause of action arising under these Terms shall exclusively be brought in such courts. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. WizerFi’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. This agreement and the terms and conditions contained herein set forth the entire understanding and agreement between WizerFi and you with respect to the subject matter hereof and supersede any prior or contemporaneous understanding, whether written or oral.

Survival

The following provisions shall survive the termination of these Terms and shall apply indefinitely.
